or provision of the Terms of Use shall not constitute a waiver of such right or provision.
If at any time any Term of Use becomes illegal, invalid or unenforceable in any respect, the legality, validity or enforceability of the remaining Terms of Use shall not be in any way be
affected or impaired thereby.
The English version of the Terms of Use shall prevail in case there is any difference between the English version and the Chinese version.
The Terms of Use shall be governed by and construed in accordance with the laws of the
Hong Kong Special Administrative Region and any dispute shall be subject to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.
Terms and Conditions of Online MPF Services
The use of any and all Member or employer’s online services for Mandatory Provident Fund ("Online MPF Services") shall be governed by the following provisions ("MPF Terms").
- The Trustee shall provide to Members and employers Online MPF Services subject to these MPF Terms and the Terms of Use. The Trustee has the right to determine and vary from time to time the scope and type of Online MPF Services to be made available including but not limited to expanding, amending, reducing or suspending any Online MPF Services at any time and/or imposing and varying any restrictions on the use of any Online MPF Services.
- Members and employers are required to enter Login ID, password and verification code to access Online MPF Services.
- Members and employers shall keep the Login ID and password ("Identification Numbers") strictly confidential. In case of loss of or failure to function of these Identification Numbers, Members or employers shall inform the Trustee in such manner as the Trustee may prescribe on this Site from time to time. Any such notification, once given, a new password will be assigned by the Trustee to the Members or employers by post accordingly.
- Members and employers shall be fully responsible for any accidental or unauthorized disclosure of any Identification Numbers to any other person and shall bear the risk of any Identification Numbers being used by unauthorized persons or for unauthorized purposes.
- Instructions given by a Member or an employer in connection with Online MPF Services (except instructions relating to Member’s transfer-in) shall not be considered to be received by the Trustee until an acknowledgement and confirmation are generated via this Site. The instructions once received by the Trustee shall be binding on Members or employers (as the case may be) whether given by Members or employers or by any other person purporting to be relevant Members or employers. The Trustee shall not be bound to verify the identity or authority of the person giving any instruction or authenticity or accuracy of such instruction apart from verifying the Identification Numbers.
- Any instructions in respect of a Member’s accounts may not be revoked once a confirmation has been generated via this Site.
- Instructions relating to a Member’s transfer-in shall not be considered as to be received by the Trustee until the Trustee has actually received the hard copy of the duly signed Member’s transfer-in form.
- Subject to (7) above, Members or employers (as the case may be) authorize the Trustee to act on any computer-generated instructions in respect of Online MPF Services. The Trustee will process the instructions as soon as practicable after receipt but the Trustee shall not be liable for any
delay in processing any instructions. The Trustee will process the instructions by reference to a Member or employer’s current MPF account information and fund unit price at the time of processing.
- The Trustee shall use its best efforts to update the information available under Online MPF Services from time to time but shall not be liable for any consequences as a result of any delay in updating such information. The information available from Online MPF Services shall be for
reference only and is not binding. The records of the Trustee of the information under Online MPF Services shall be final and conclusive.
- Unless due to gross negligence or willful default of the Trustee or their respective officers or employees, the Trustee shall not be liable to any Member, employer or any other person for the consequences arising from or in connection with any interruption, interception, suspension, delay
or failure in providing Online MPF Services, in transmitting the information relating thereto or in connecting with Online MPF Services caused by any acts, omissions or circumstances beyond the reasonable control of the Trustee, including, without limitation, failure of any communication network,
act or omission of any third party service providers, mechanical failure, power failure or any laws, rules or regulations.
- The Trustee shall not be liable for any loss, damage or expense (direct, indirect or consequential) suffered by any Members arising from or in connection with any delay in acting on any instruction or for any inability to act as a result of any instruction being unclear or incomplete or
the Member failed to submit an instruction by the cut-off time specified by the Trustee.
- Except where the context otherwise requires, words denoting the singular include the plural and vice versa; words denoting any one gender include all genders; words denoting persons include incorporations and firms and vice versa.
- The English version of these MPF Terms shall prevail in case there is any difference between the English version and Chinese version.
Terms and Conditions of Online Member Application Service
The use of the service for online application for membership ("Online Member Application Service") of China Life MPF Master Trust Scheme ("Scheme") shall be governed by the following provisions ("Online Application Terms").
- The Trustee shall provide to you Online Member Application Service subject to these Online Application Terms and the Terms of Use. The Trustee has the right to determine and vary from time to time the scope of Online Member Application Service to be made available including but not limited
to expanding, amending or suspending Online Member Application Service at any time and/or imposing and varying any restrictions on the use of Online Member Application Service.
- In order to facilitate the processing of your online application by the Trustee, you agree to provide the relevant personal data and other information as specified in the applications forms, transfer forms and/or other forms as required (collectively "Forms"). The personal data and
information provided by you in these Forms is true and accurate.
- In case you apply to become a personal account holder of the Scheme, you must complete and submit the personal account holder application form together with the relevant transfer form as required at the same time to the Trustee via this Site.
- Your online application for membership of the Scheme through Online Member Application Service will only be considered as complete subject to (a) your input of all the required personal data and information to the Forms and submission of the Forms via this Site; (b) generation of
acknowledgement and confirmation attaching the Forms containing the required information; and (c) the Trustee’s actual receipt of the Forms duly signed and returned by you. Your personal data provided to the Trustee will only be retained for as long as it is necessary to complete the application
for membership. If you do not return the duly signed Forms and a copy of HKID card or passport to the Trustee within 90 calendar days from the date of generation of acknowledgement and confirmation referred to in (b) before , your personal data provided to the Trustee will be destroyed.
- The Trustee will process your application through Online Member Application Service as soon as practicable after receipt but the Trustee shall not be liable to you for any delay in processing your application .
- Unless due to gross negligence or willful default of the Trustee or their respective officers or employees, the Trustee shall not be liable to you or any other person for the consequences arising from or in connection with any interruption, interception, suspension, delay or failure in
providing Online Member Application Service in transmitting the information relating thereto or in connecting with Online Member Application Service caused by any acts, omissions or circumstances beyond the reasonable control of the Trustee, including, without limitation, failure of any
communication network, act or omission of any third party service providers, mechanical failure, power failure or any laws, rules or regulations.

Personal data will be collected only for lawful and relevant purposes and all practicable steps will be taken to ensure that personal data held by the Company is accurate. the Company will take all practicable steps to ensure security of the personal data and to avoid unauthorized or accidental access, erasure or other use. The provision of your personal data is voluntary. Please note that if you do not provide us with the required personal information, the Company may not be able to provide your requested information, products or services.
- How do we collect personal data?
We will collect and store any information you enter the contact form or Smart Assistant Jarvis system on our website. We may also legally obtain personal or non-personal data of you from the affiliated entities. We may also collect some information about your computer or other devices used when you visit this website.

- offering and providing to you the mandatory provident fund ("MPF") scheme, occupational retirement scheme (“ORSO”) or related products/services of the Company and other companies of the China Life Group (“affiliates”), and administering, maintaining, managing and operating such schemes or related products/services;
- processing and evaluating any applications or requests made by you or in respect of your benefits in the MPF/ORSO schemes or related products/services offered by the Company and the affiliates;
- providing subsequent services to you on the MPF/ORSO schemes or related products/services of the Company and the affiliates and the administration thereof e.g. enrollment and termination, variations, calculation of contributions and benefits and the processing of redemption/withdrawal/switching/transfer requests;
- any purposes in connection with any claims or benefits payment or transfer requests made by or against or otherwise involving you or your benefits in respect of the MPF/ORSO schemes or related products/services provided by the Company and/or the affiliates;
- evaluating your financial needs with respect to the MPF/ORSO schemes and related products/services;
- designing new or enhancing existing MPF/ORSO schemes or related products/services of the Company and/or the affiliates;
- conducting market or actuarial research for statistical or similar purposes undertaken by the Company and/or the affiliates, the MPF/ORSO industry or the respective regulators;
- matching any data held which relates to you from time to time for any of the purposes listed herein;
- meeting requirements imposed by any applicable, present, existing or future law, rules, regulations, codes of practice or guidelines (including sending of information) or assisting with law enforcement purposes, investigations by police or other government or regulatory authorities in Hong Kong or elsewhere;
- conducting identity check and/or debt collection for the MPF/ORSO schemes and related business;
- carrying out other services in connection with the operation of the Company 's MPF/ORSO schemes or related business;
- sending out administrative communications about any account you may have with the Company , MPF/ORSO schemes communications or future changes to the Company ’sPersonal Information Collection Statement;
- performing relevant due diligence procedures in accordance with the Common Reporting Standard (or Automatic Exchange of Financial Account Information) as set out in the Inland Revenue Ordinance (Cap. 112);
- other purpose(s) as notified at the time of collection; and
- other purpose(s) directly relating to any of the above.
- Who do we share your personal data with?
Personal data will be kept confidential but, subject to the provisions of any applicable law, may be shared with the below parties for the purpose of exercise and performance of the Company 's functions conferred or imposed by or under the MPF/ORSO laws:
- any of the affiliates;
- any person in connection with any claims made by or against or otherwise involving you or your benefits in respect of the MPF/ORSO schemes or related products/services provided by the Company and/or the affiliates;
- any agent, contractor or third party who provide services in connection with the MPF/ORSO schemes or related product/services provided by the Company and/or the affiliates, including any service providers engaged by the Company , MPF intermediary, fund management Company or financial institution;
- any agent, contractor or third party who provides administrative, technology, data processing, telecommunications, computer, payment, debt collection, securities clearing, call centre services or other services to the Company and/or the affiliates in connection with the MPF/ORSO schemes or related business;
- any actual or proposed assignee, transferee, participant or sub-participant of our rights or business; and
- any law enforcement agency, government department or other appropriate governmental or regulatory authority (which may be further transferred tolaw enforcement agency, government department or other governmental or regulatory authority of certain other jurisdiction(s) to whom the Company and/or the affiliates are requested or required by any applicable, present, existing or future law, rules, regulations, codes of practice or guidelines to make disclosures.
Your personal data may be provided to any of the above parties who may be located in Hong Kong or outside of Hong Kong, and in this regard, you consent to the transfer of your personal data outside Hong Kong.

- How do I opt out from direct marketing?
You may withdraw your consent to the use of your personal data for direct marketing purposes at any time, and thereafter the Company shall, without charge to you, cease to use such data for direct marketing purposes. - How do I access and correct my personal data?
Under the Personal Data (Privacy) Ordinance, you have the right to ascertain whether the Company holds your personal data, to correct any data that is inaccurate, and to ascertain the Company 's policies and practices in relation to personal data. You may also request the Company to inform you of the type of personal data held by it.
